Per Property Code Section 209.0094, the current legislation from the 2023 Regular and Special Sessioins was signed by the Governer as of
November 13, 2023. The process for collecting dues has been amended as follows:
- Dues are invoiced semiannually on January 1 and July 1.
- Assessments must be paid within 30 days from the date of invoice.
- If payment is not received in 30 days, a $25 late fee will posted to the homeowner's account.
- Homeowner has an additional 30 days to pay invoice plus late fee.
- If payment is not received within the additional 30 days, a finance charge will be posted to the homeowner's account. Homeowner will also receive a "possible lien filing" letter and given 90 days to pay in full.
- If payment is not received in 90 days of date of the letter, a finance charge will be added to homeowner's account and a lien will be filed on the property, along with a $100 lien filing fee posted to the account.
